Terms and Conditions

By providing payment or payment information by credit card number, either by advancement of deposit or balance in full, the event package purchaser agrees to be bound by the following terms and conditions. This agreement for the purchase of event services is made between gameplan event group, hereinafter referred to as “gameplan” and the event package purchaser, hereinafter referred to as “Buyer”.

1. Responsibility - Gameplan agrees to offer their services to buyer as an agent responsible for procuring accommodations, transportation, hospitality, tickets and other services (together as “event services”) that make up their event package on behalf of the buyer. Gameplan is responsible for procuring such event services from suppliers, as outlined in the event package description upon booking confirmation, except to the extent that event services cannot be supplied due to reasons beyond the gameplan’s control. Gameplan is not in any way liable for personal injury, property damage, inconvenience, loss of time, or loss arising out of the act, omission or negligence of any supplier of event services (e.g. direct air carrier, motor coach company, and hotel) or any person rendering any services or accommodations in conjunction with the event package. Gameplan is not in any way responsible for any injury, damage, or loss due to reason of theft, accident, mechanical breakdown, government action, weather, failure to make timely payments, or any reason beyond the control of gameplan.

2. Cancellations and Refunds - Gameplan requires written notification of cancellation. Cancellation notifications received at least 60 days prior to package start date or arrival date are subject to a cancellation fee equal to the initial deposit. Cancellations received less than 60 days prior to package start date or arrival date are penalized at 100%. All travel documents, if issued, must be returned prior to any refund being issued. Refunds are not made for unused travel services or any portion thereof. If cancellation by one or more passengers alters the room requirements of the remaining passengers, passengers still traveling may be required to pay a revised rate. Unfortunately, due to the nature of event services, gameplan regrets that we cannot make exceptions for personal emergencies.

3. Conditions: All prices are subject to change until the reservation confirmation is received by Buyer. Gameplan reserves the right to accept or decline any reservation in its sole discretion. Gameplan reserves the right to cancel any reservation and will remit a full refund to the cancelled party. If the event is cancelled or postponed for any reason whatsoever, gameplan will refund to buyer all deposits paid by buyer not yet utilized by gameplan to purchase package components, and gameplan will use its best efforts to obtain refunds for any package components already purchased.

4. Hotel Accommodations - Guests agree to be responsible for all incidental charges incurred in excess of those covered by the package. Incidental charges can include food, beverages, telephone use, internet use, parking fees, and other hotel charges. All hotels require a credit card or deposit for incidental charges at time of check-in. Hotels expect departing guests to vacate rooms by 12 noon and arriving guests to check-in later than 3pm to allow for cleaning and maid service. Host hotels do their best to minimize inconvenience and store luggage if you arrive early or need to depart late. Gameplan reserves the right to substitute confirmed hotels with comparable accommodations at either gameplan’s or the hotel’s discretion. Accommodations are subject to availability.

4. Event tickets - Event tickets purchased by gameplan are procured on the open market from secondary ticket sources. The price of event tickets reflects the high market demand for these tickets. Consequently, the ticket price offered can be several times higher than the original face value price that is printed on the tickets. Pursuant to California law, gameplan hereby discloses that the purchase price of the tickets contains a service charge or profit which has been added to the face value of the tickets, and that, as of this date, the event tickets may not be in the gameplan’s possession, may have no contract to obtain the tickets at a certain price from a person in possession of the tickets, or from a person who has a contractual right to obtain the tickets from the primary contractor. Ticket upgrades, subject to availability, may be purchased at an additional cost. Tickets cannot be guaranteed together in quantities greater than two (2), in odd numbers, or in specific rows or sections.

5. Charter Air Transportation – ONLY FOR PACKAGES THAT INCLUDE A CHARTER FLIGHT. Flight check-in will begin two hours prior to scheduled departure time and passengers will be checked-in from a manifest. No airline ticket will be issued. Flight ticketing will be by e-ticket. A government issued photo id is required for flight check-in. Flights will be operated in compliance with all applicable Department of Transportation regulations and price may be adjusted on a pro-rata, per seat basis in accordance with any fuel price increase passed through gameplan by the direct air carrier. Flight times will be finalized two weeks prior to departure. Buyer recognizes that gameplan is not the Direct Air Carrier and does not control the flight schedule. Buyer agrees that gameplan shall have no liability for any delays or change of schedule unless gameplan is the sole cause for such delay or change of schedule. Should any delay or change of schedule occur, and should gameplan recover any amount as damages from the Direct Air Carrier for such delay or change of schedule, gameplan agrees to share the net recovery on a pro-rata basis.

6. Affiliation - Gameplan is an independently owned and operated business. Any reference to specific events herein is made only for the clear identification and reference for potential Buyers, and reference to a specific event is not intended to imply, nor should it be understood or assumed that gameplan is endorsed by, sponsored by, approved by or otherwise affiliated with the organizers and/or sponsors of events referenced herein. Gameplan Event Group is a D/B/A of Imaginative Travel Corp., a California corporation.
